Police have identified Berkeley resident Maceo Smith, 33, as the homicide victim in a shooting on Southside Tuesday afternoon.

The shooting followed what police called a verbal "back and forth" between Smith, a Berkeley High School graduate, and another male at the intersection of Durant Avenue and Bowditch Street, though witnesses said there were about four men involved.

Smith sustained multiple gunshot wounds and was pronounced dead at the scene in Berkeley's fifth homicide of the year.

A second victim in the shooting is being treated at Highland General Hospital for non-life-threatening gunshot wounds. Police are not saying how he is connected to the incident, but they said "he is a victim of a violent crime."

According to Mark Coplan, spokesperson for Berkeley Unified School District, Smith has three children who all attend Berkeley public schools-two in elementary school and one in middle school.

Smith's mother, Rita McIntyre, works in nutrition services at Willard Middle School and has worked in the district for 20 years, Coplan said.

"There are many at (Berkeley Unified School District) that grieve with her," he said.

Berkeley police Sgt. Mary Kusmiss said neither Smith nor the second victim is affiliated with UC Berkeley.

UC Berkeley sophomore June Bott said she was waiting for the 52L bus on her way to convocation when she saw Smith and a group of men walk by and stop near the intersection to talk.

Bott said that after several minutes, she heard gunshots.

"I just heard the shots, heard three or four," she said.

Bott said she then went into CK Mini Market and when she looked out she saw the victim in a white T-shirt covered in blood, saying "I've been shot, I've been shot."

She said she saw Smith run from the intersection toward a parking lot east of Top Dog.

According to Bott, Smith then met up with a woman in the parking lot who was trying to get him into a car, but he already appeared to be limp.

She said the woman called for bystanders to help get him into a car.

Marty Keith, a UC Berkeley alumnus, said he was at St. Joseph's seminary when he heard six shots in rapid succession.

He said Smith ran to a 1998 blue Honda Accord in the parking lot and got in the backseat. Keith and three or four other men ran to the car where they found Smith lying face down in the back seat with wounds to his chest.

Keith said the men pulled Smith out of the car onto his back and began to administer CPR, at which point police arrived and administered first aid for about 30 minutes.

Bott said two to three "younger guys" scattered after the shots. She said one of them, the second victim, was covered in blood and drove away in a Cadillac.

One witness, Adolfo Salazar, said he saw a man running down Durant toward Telegraph Avenue with a gun; other witnesses said they did not see a gun.

Following witness reports, police said they pursued a silver Cadillac to Highland General Hospital in Oakland. The second victim, who drove the car, was detained and interviewed by homicide detectives, but has not been arrested, Kusmiss said Tuesday.

This is the second homicide in Berkeley within the last two weeks.

UC Berkeley senior Chris Wootton, 21, was fatally stabbed on May 3 outside the Chi Omega sorority house, less than one mile away from Tuesday's shooting. The suspect in the case, 20-year-old Berkeley resident Andrew Hoeft-Edenfield, has not yet entered a plea.
