After listening to nearly one hundred residents voice their opinions on whether to appeal a superior court judge's ruling in the lawsuit over a proposed athletic center at UC Berkeley, Berkeley City Council members reached an impasse in their deliberations Thursday, unable to muster up the votes necessary to make an official decision.

During a special meeting called by Mayor Tom Bates, council members and residents convened in city hall to discuss whether to appeal Alameda County Superior Court Judge Barbara J. Miller's ruling made on Tuesday that said the university could proceed with construction of the athletic center.

Miller ruled that the university has brought its construction proposal for a new athletic center near Memorial Stadium into compliance with earthquake safety and environmental quality laws.

The meeting began with a public comment session, opening the floor for residents, students and protesters who expressed their opinions on the case.

The California Oak Foundation and the Panoramic Hill Association have both announced their decisions to file an appeal.

The council still has over 50 days to decide whether or not to appeal the court ruling.
