No Charges to Be Filed Following Fight in Eshleman

Campus officials announced Friday that the Alameda County District Attorney will not file charges in connection with an altercation that took place on Nov. 13 in Eshleman Hall.

A letter from Dean of Students Jonathan Poullard stated the campus was informed Dec. 12 of the district attorney's decision not to file charges on the grounds that witness testimonies were "both inconsistent and ambiguous."

Although the case is now considered closed, UCPD is still willing to take additional witness statements and forward any new information to the district attorney.

Three people were initially cited with battery by police in connection with the incident, two of whom were UC Berkeley students.

The incident took place after three students hung Palestinian flags on an Eshleman floor balcony in response to what they referred to as anti-Palestinian lyrics in a concert taking place on Lower Sproul Plaza.

Three concert attendees then went up to the balcony in an effort to remove the flags, including ASUC Senator John Moghtader and former ASUC Senator Gabe Weiner.

After a physical confrontation between the two groups, Weiner and two of the Palestinian students-senior Dina Omar and senior Husam Zakharia-were cited.

Moghtader was not cited and has said he was not involved in the altercation, but has faced criticism and a recall petition following the events.

Although the district attorney will not be pursuing charges related to the incident, campus officials say the Center for Student Conduct and Community Standards will be conducting its own investigation and may still issue sanctions against those involved.
