A UC Berkeley student was charged Wednesday after allegations that he sexually assaulted another member in his fraternity, Alpha Epsilon Pi.
Jordan Schaer, 21, was charged with one count of attempted sexual penetration by a foreign object and one count of sexual battery by restraint, according to a complaint from the Alameda County District Attorney’s Office.
The victim, one of Schaer’s fraternity brothers and housemates, alleged that Schaer woke him up and groped and touched him inappropriately, according to an affidavit. The two had no prior sexual relationship, and Schaer did not have permission to be in the victim’s room or touch him, the affidavit said. Schaer was arrested Feb. 13 at the Alpha Epsilon Pi fraternity house.
Kellin Cooper, Schaer’s attorney, said he believes that when the evidence is finally submitted, his client will be cleared.
“Unless there’s corroboration, I feel like he’ll be totally exonerated,” he said.
Schaer is currently out of custody on bail, and is scheduled to file a plea March 13, according to the district attorney’s office.
