Despite being asked to vacate her position as District 7 BART Board of Directors member in mid-March due to discrepancies about her home address, Lateefah Simon will continue to serve on the board.

According to BART Board President Rebecca Saltzman and BART general manager Bob Powers, the board has not determined that a vacancy exists in District 7. A vacancy must be declared by a court order in a special judicial proceeding or by formal action by the board, not by BART staff alone, according to Saltzman and Powers.

“Having Lateefah resume her position on the board while this matter is handled by outside legal experts is a win for our riders, the BART District, and specifically the voters of District 7 who elected Director Simon based on her leadership, advocacy, and proven ability to advance equity at BART,” Saltzman and Powers said in a joint press release.

Saltzman and Powers noted BART is committed to transparency and will continue to work with outside legal counsel throughout the process.
