The state of California is pushing back on Berkeley City Council’s attempts to limit construction of accessory dwelling units, or ADUs, in the Berkeley Hills, arguing that the council’s actions violate state law.

Berkeley City Council’s passage of an ordinance that limits the development of accessory dwelling units, or ADUs, and junior accessory dwelling units, or JADUs, in the Berkeley Hills, may allegedly be in violation of state law.

Berkeley City Council passed ordinances Tuesday that limit ADU and JADU development in the very high fire hazard zone of the Berkeley Hills.

Berkeley City Council approved a new Accessory Dwelling Unit, or ADU, ordinance to enable homeowners to help combat the current housing crisis “in their own backyards.”

Berkeley City Council adopted an ordinance to include garage conversions under the definition of accessory dwelling units, or ADUs, and increased the allowable ADU maximum height to 20 feet in all districts excluding areas at high fire risk at their regular meeting Tuesday.

Berkeley City Council discussed at its Tuesday meeting methods to encourage the construction of accessory dwelling units, a type of auxiliary building hoped to provide more affordable housing, as well as space for aging residents.
