The city of Berkeley is claiming that the closure of BPG would lead to a significant decrease in city tax revenue and would encourage illegal marijuana sales. The closure would also negate the city’s efforts to implement regulated medical marijuana dispensaries, which it stated “positively impact the health, safety and well-being of all City of Berkeley residents.”

The city of Oakland has filed a lawsuit against U.S. authorities that claims the federal government has overstepped its jurisdiction in the attempted closure of a local medical marijuana dispensary.

The legislation would prevent the U.S. Department of Justice from using forfeiture laws to seize property from medical marijuana dispensaries that are compliant with state laws.
