Alameda County judge rules in favor of city of Berkeley in lawsuit against 1900 Fourth Street developers

An Alameda County judge denied a petition for a mandate that would have allowed developers to build on about 28,000 square feet at the city of Berkeley’s 1900 Fourth Street location.

Developers of 1900 Fourth St. sue city of Berkeley over alleged state law violation

Ruegg & Ellsworth and the Frank Spenger Company are suing the city of Berkeley and the city’s department of planning and development for rejecting their project at 1900 Fourth St. on the grounds that the city’s decision allegedly goes against SB 35.
